Kennedy revealed last week that he's retiring from his post after 30 years in office, raising concerns that Trump' new pick could potentially reverse the Supreme Court decisions on Roe V. Wade, which legalized access to safe abortions, and Obergefell v. Hodges, which legalized same-sex marriages. Trump also spoke about the increasing number of Democrats who have called for abolishing Immigration and Customs Enforcement (ICE), something Trump said he considers also considers beneficial for Republicans headed into the midterms.

Sen. Susan Collins, R-Maine, one of only two Republican senators who supports abortion rights, told ABC's This Week she's looking for a nominee who would demonstrate a respect for precedent and that she sees Roe as settled law.

She reiterated that Trump does not intend to ask any of the candidates for their views on Roe v. Wade, the 1973 case that affirmed women's right to abortion. "If chosen as the nominee, she will be the deciding vote to overturn Roe v. Wade and to strike down preexisting conditions protections in the ACA". Republicans now hold a 51-seat majority in the Senate, and a Supreme Court nominee will be confirmed by a simple majority of votes. Teams of attorneys from the White House Counsel's Office and Department of Justice are working to ensure the President has all the information he needs to choose his nominee. "I'm actually told that I shouldn't be".

US President Donald Trump has appointed an Indian-American official, Raj Shah, to a key role in the contentious process of the appointment of the next justice of the Supreme Court, the White House announced on Monday.

If there is a danger of losing Republican votes, the nominee could prevail by courting Democratic senators seeking re-election this year in states Trump carried in 2016, including Sens.

Possible nominees being eyed include Thomas Hardiman, who serves alongside Trump's sister on the Philadelphia-based 3rd U.S. Circuit Court of Appeals, and Raymond Kethledge, a federal appeals court judge who clerked for Kennedy.

Hume said if Trump loses the support of Collins and Murkowski "it's hard to believe" the Republicans would "pick up any Democrats" to achieve a majority confirming the nominee. Susan Collins of ME and Lisa Murkowski of Alaska, moderate Republicans who support access to abortion services and aren't up for re-election, making it less likely either will feel pressure to be in lockstep with the polarizing president. "Susan Collins can not simultaneously say she supports Roe v. Wade and support anybody on that list; that would be quite hypocritical".

"You don't overturn precedent unless there's a good reason", Graham said. "If he picks someone who is hardcore on Roe v. Wade or hardcore on repealing health care that's a bigger lift".

"Well, I hope they keep thinking about it", Trump said of Democrats like Sen.
